Legal Assistance for People Seriously Injured in Washington Road Rage Incidents
If you have been seriously injured or disabled in a Washington road rage accident or assault, you may be seeking answers to your legal questions. The Farber Law Group, a Bellevue motor vehicle accident law firm, may be of assistance to you.
What is Road Rage?
To begin with, road rage is not aggressive driving, and it is important to distinguish between the two. Road rage is both a criminal and civil offense, and it occurs when a driver uses a motor vehicle to assault another driver or passenger. Acts of violence can occur when vehicles are moving but can also occur after a motor vehicle accident or some other incident that occurred while driving. Some incidents of road rage occur after a minor fender bender when one driver pulls a weapon such as a knife or a gun. Other cases of road rage have occurred when a driver has intentionally or unintentionally hit another vehicle, ran them off the road, or caused an accident.
Who Commits Road Rage?
There have been incidents of road rage among all age groups of drivers, but the majority of drivers who explode into road rage are young (between 18 and 26), poorly educated, and with prior history of drugs, alcohol, and violence. Others involved in road rage incidents are older drivers without a criminal history who have experienced some emotional trauma including the loss of a job or marriage. Some involved in incidents of road rage are suffering from mental illness.
Where does Road Rage Occur?
In 2006, AutoVantage, a national auto club, ranked Seattle/Tacoma as one of the "Most Courteous Cites" with the least number of road rage incidents and the most courteous drivers.
What to do if You've Been Injured in a Road Rage Incident
If you have suffered injuries in an incident of road rage, your personal injury attorney can establish liability for assault. Based on your medical bills and medical reports you can make a claim for compensation for your damages.
A prosecuting attorney may prosecute the criminal charges against the aggressor. In a criminal case, proof of a crime must be beyond a reasonable doubt. A personal injury attorney, however, can help you institute a civil case. In a civil case, the proof is established by a preponderance of the evidence.
